La diligencia se realizar\u00e1 luego de que la acci\u00f3n constitucional fuera admitida a tr\u00e1mite, tras superar un conflicto de competencia judicial.<\/p>\n\n\n\n<p>La <strong>defensa de Jorge Glas<\/strong> inform\u00f3 que el <strong>mi\u00e9rcoles 24 de diciembre<\/strong> recibi\u00f3 <strong>dos notificaciones relevantes<\/strong>. La primera corresponde a la convocatoria formal de la audiencia de <em>habeas corpus<\/em>; la segunda, a la <strong>notificaci\u00f3n escrita de la sentencia del caso Reconstrucci\u00f3n de Manab\u00ed<\/strong>, cuya condena fue dictada oralmente el <strong>30 de junio<\/strong>. Seg\u00fan los abogados, el retraso en la entrega del fallo escrito habr\u00eda afectado el <strong>derecho a la defensa y al recurso<\/strong>, al limitar la posibilidad de presentar apelaciones dentro de los plazos legales.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Admisi\u00f3n del recurso y competencia judicial<\/strong><\/h2>\n\n\n\n<p>El recurso de <em>habeas corpus<\/em> fue presentado el <strong>22 de diciembre<\/strong>. Inicialmente, la <strong>Corte Provincial de Santa Elena<\/strong> se declar\u00f3 incompetente y remiti\u00f3 el proceso para sorteo. Posteriormente, un <strong>juez penal avoc\u00f3 conocimiento del caso y admiti\u00f3 a tr\u00e1mite la acci\u00f3n constitucional<\/strong>, habilitando la convocatoria inmediata a la audiencia p\u00fablica.<\/p>\n\n\n\n<p>Esta decisi\u00f3n permiti\u00f3 que el caso avance en sede constitucional, donde se evaluar\u00e1n las condiciones de privaci\u00f3n de libertad y la legalidad de las actuaciones estatales en relaci\u00f3n con Jorge Glas.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Audiencia p\u00fablica y obligaci\u00f3n de presentar a Jorge Glas<\/strong><\/h2>\n\n\n\n<p>El juez dispuso que la audiencia se desarrolle bajo el <strong>principio de \u201ccuerpo presente\u201d<\/strong>, lo que obliga al <strong>Estado a presentar f\u00edsicamente a Jorge Glas<\/strong> durante la diligencia. La providencia advierte que el incumplimiento de esta disposici\u00f3n podr\u00eda acarrear <strong>sanciones conforme a la Ley Org\u00e1nica de Garant\u00edas Jurisdiccionales y Control Constitucional<\/strong>.<\/p>\n\n\n\n<p>Adem\u00e1s, se orden\u00f3 la <strong>comparecencia obligatoria<\/strong> del <strong>Ministerio del Interior<\/strong>, el <strong>SNAI<\/strong>, la <strong>Direcci\u00f3n del Centro de Privaci\u00f3n de Libertad N.\u00ba 1 de Santa Elena<\/strong> y la <strong>Procuradur\u00eda General del Estado<\/strong>, as\u00ed como la notificaci\u00f3n al <strong>centro de m\u00e1xima seguridad La Roca<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Medidas cautelares y atenci\u00f3n m\u00e9dica<\/strong><\/h2>\n\n\n\n<p>De manera previa, el juez dict\u00f3 <strong>medidas cautelares constitucionales inmediatas<\/strong> para proteger los <strong>derechos a la vida, integridad personal y salud<\/strong> del exvicepresidente. En ese marco, se dispuso que el <strong>Ministerio de Salud P\u00fablica<\/strong>, el <strong>SNAI<\/strong> y las autoridades penitenciarias act\u00faen de forma coordinada para garantizar su atenci\u00f3n m\u00e9dica.<\/p>\n\n\n\n<p>La providencia establece que, <strong>si existe una necesidad m\u00e9dica debidamente justificada<\/strong>, Jorge Glas deber\u00e1 ser <strong>trasladado a un hospital o centro de salud p\u00fablico<\/strong>, conforme a la recomendaci\u00f3n del personal m\u00e9dico del centro penitenciario.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Inversi\u00f3n de la carga probatoria<\/strong><\/h2>\n\n\n\n<p>El juez record\u00f3 que en materia constitucional rige el <strong>principio de inversi\u00f3n de la carga probatoria<\/strong>, por lo que corresponde a las entidades accionadas demostrar la legalidad de la detenci\u00f3n.
