Entre los puntos m\u00e1s relevantes del texto se encuentra la <strong>reincorporaci\u00f3n de las sociedades an\u00f3nimas deportivas (SAD)<\/strong> y la inclusi\u00f3n de <strong>nuevas prohibiciones relacionadas con los pron\u00f3sticos deportivos<\/strong>, orientadas a reforzar la integridad y transparencia del sistema.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Retorno de las sociedades an\u00f3nimas deportivas (SAD)<\/strong><\/h2>\n\n\n\n<p>Las <strong>sociedades an\u00f3nimas deportivas<\/strong> vuelven a formar parte del ordenamiento jur\u00eddico tras haber quedado sin efecto luego de que la <strong>Corte Constitucional<\/strong> declarara la inconstitucionalidad de la <strong>Ley de Solidaridad Nacional<\/strong>. Dicha ley, aprobada en junio, hab\u00eda permitido que clubes y equipos profesionales se transformaran en SAD; sin embargo, el fallo de septiembre anul\u00f3 todas sus disposiciones por vicios de forma en su tramitaci\u00f3n legislativa.<\/p>\n\n\n\n<p>El nuevo proyecto de <strong>Ley del Deporte<\/strong> retoma esta figura y la desarrolla en un cap\u00edtulo espec\u00edfico. Define a las SAD como <strong>compa\u00f1\u00edas de derecho privado, de naturaleza mercantil<\/strong>, constituidas bajo el tipo societario de sociedad an\u00f3nima, con capital dividido en acciones negociables. Estas entidades deber\u00e1n tener como objeto exclusivo el desarrollo de actividades deportivas y estar\u00e1n obligadas a incluir la sigla <strong>\u201cSAD\u201d<\/strong> en su denominaci\u00f3n social.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Control, requisitos y obligaciones de las SAD<\/strong><\/h2>\n\n\n\n<p>Las SAD formar\u00e1n parte del <strong>Sistema Deportivo Nacional<\/strong>, con equivalencia a los clubes deportivos para efectos de participaci\u00f3n en competencias oficiales. Estar\u00e1n sujetas tanto a la <strong>Ley de Compa\u00f1\u00edas<\/strong> como a la normativa deportiva vigente y bajo la supervisi\u00f3n de la <strong>Superintendencia de Compa\u00f1\u00edas, Valores y Seguros<\/strong>.<\/p>\n\n\n\n<p>Entre los requisitos establecidos constan la <strong>inscripci\u00f3n en el Registro Nacional de Organizaciones Deportivas<\/strong>, la presentaci\u00f3n de un <strong>plan deportivo anual<\/strong>, informes t\u00e9cnicos de las federaciones correspondientes y el cumplimiento de <strong>indicadores m\u00ednimos de desempe\u00f1o e infraestructura<\/strong>. El incumplimiento podr\u00e1 derivar en sanciones administrativas, cancelaci\u00f3n del registro deportivo o incluso la disoluci\u00f3n de la sociedad.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Prohibiciones en pron\u00f3sticos deportivos<\/strong><\/h2>\n\n\n\n<p>El proyecto incorpora un r\u00e9gimen estricto de <strong>principios y prohibiciones<\/strong> para proteger la integridad del deporte profesional. Se establece que <strong>dirigentes, jugadores, entrenadores y organizaciones deportivas<\/strong> no podr\u00e1n participar directa ni indirectamente en <strong>pron\u00f3sticos deportivos<\/strong> relacionados con disciplinas sobre las que tengan influencia.<\/p>\n\n\n\n<p>Asimismo, se proh\u00edbe que dirigentes mantengan <strong>v\u00ednculos financieros o comerciales con operadores de apuestas<\/strong>, restricci\u00f3n que se extiende a familiares cercanos.
